The Government has launched a consultation to improve the implementation and enforcement of the minimum energy efficiency standards (MEES) that landlords are legally obliged to meet on privately rented properties.
Since MEES was implemented in 2016, responsibility for the enforcement of the rules and how audits are conducted has not been clear.
However, the consultation suggests an incremental milestone approach providing landlords with two compliance windows.
It is being proposed that landlords will be required to acquire a valid EPC by 1 April 2025, and have until 1 April 2027 to improve the building to at least an EPC rating of C.
At the next date milestone of 1 April 2030, the landlord must prove the building has improved to at least an EPC rating of B.
The consultation hopes to provide the Government with a greater chance of achieving its target of net zero carbon emissions in the UK by 2050.
The consultation closes on 9 June 2021.
Under MEES regulations, landlords must not renew existing tenancies, or grant new tenancies if the building has less than the minimum EPC rating of E, unless the landlord registers an exemption.
Non-compliance penalties are estimated at £5,000 and it will be deemed unlawful for landlords to let the property.
